Filing a complaint with the Québec Ombudsman is an important step that adds weight to our claims!
How to proceed:
Contact the Québec Ombudsman at 1-800-463-5070.
Tell them you wish to file a complaint against Retraite Québec because of the unfair and discriminatory penalty imposed on your retirement pension as a person with a disability and ask to open a file.
We also suggest you tell them that you vehemently condemn Retraite Québec's complete lack of transparency in its amendment letters.
For those aged 60 to 65 in 2024, the three points to condemn are:
1) The government amended the law in 2022, circumventing the discriminatory aspect of the disability penalty and now claiming that the penalty is strictly age-related;
2) In its 2024 amendment letters, Retraite Québec makes no mention of the penalty that is already applied to the pension portion of the payment; and
3) These same letters also fail to mention the option to take or refuse the retirement pension at age 60.
For those aged 65 and over, the lack of transparency is also to be condemned:
1) Retraite Québec had not mentioned the existence of the penalty in its 2022 letter, which referred to the reduction of said penalty from 36% to 24%, stating instead a recalculation of the retirement pension; and
2) The letter previously sent at age 65, when the disability pension was converted to a retirement pension, made no mention of the penalty already applied to the retirement pension being paid.
The Québec Ombudsman will open personal file for you and send you a confirmation letter with a reference number, but they may also call you back to give you the reference number over the phone.
The letter you will receive is the same for everyone. The Ombudsman tells you they remain sensitive to your issues and that they will assess the possibility of intervening, at an opportune time.
Your personal file will then be added to the Québec Ombudsman's collective file on the Retraite Québec penalty, a sectorial watch pending a decision by the Superior Court. Your personal file will subsequently be closed, but it will still be possible for you to contact the person assigned to your closed personal file.
